Sinai Health Foundation Duck and Dodge in support of NF1 2025: Release and Waiver of Liability
Please carefully review the following release and waiver of liability. You must agree to the terms and conditions below in order to participate in this event. PLEASE NOTE THAT IF YOU ARE UNDER AGE 18 YOU MUST HAVE A PARENT/GUARDIAN SIGN THE RELEASE AND WAIVER OF LIABILITY and give permission for your participation in the event.
I, on behalf of myself (spectator, participant, competitor, volunteer or otherwise)(“Event Participant”) and if applicable, the minor(s) listed below for whom I am a parent or legal guardian (the "Minor(s)"), wish to participate in Duck and Dodge in support of NF1 2025 (“the Event”) benefitting the Sinai Health System, Sinai Health Foundation, Bridgepoint Foundation and Arthritis Research Foundation, scheduled on January 28, 2025 at Skyzone Trampoline Park:45 Esandar Dr, Toronto, ON M4G 4C5 as well as in various pre and post event activities (collectively, the "Event"). I on behalf of myself and the Minor(s) (if any) agree to conduct myself in a safe manner and abide by all rules, regulations, and event instructions of the Event, as well as all applicable municipal, provincial and federal laws and regulations, including without limitation any and all public health guidelines and measures put in place by the Event organizers or any public health authority regarding the prevention and mitigation of spreading infectious diseases such as COVID-19.
- Entry Requirements
The Event Participant must be a resident of Canada aged 18 or over or who, if under 18, has obtained the express approval of a parent/guardian – who has agreed to all of these terms and conditions – before completing registration in the Event.
The Foundation may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application for registration and may seek verification of the above entry requirements in whatever manner it sees fit. Following registration, participation in the Event is subject to the sole discretion of the organizers of the Event, and may be limited or terminated by the Foundation, with or without cause.
- Health & Safety
I am responsible for ensuring that I or any Minor(s) have adequately and appropriately prepared both physically and mentally for the Event and by entering the Event, I warrant that I have done so and am not aware of any illness, injury, physical disability or impairment which may cause me or any Minor(s) injury or death during the Event. If I or they have any health issues or doubts prior to or during the Event, I/we warrant that I/we will immediately seek appropriate medical advice. If, during the Event, the Event Participant becomes ill or is injured, the Event Participant warrants that they will cease participation in the Event until they have sought the advice of a medical professional.
The Event Participant will wear appropriate attire/gear at all times during the Event.
- Waiver and Acknowledgement
I/we acknowledge and agree that the Sinai Health System, Sinai Health Foundation, Bridgepoint Foundation and Arthritis Research Foundation, their directors, officers, employees, independent contractors, agents, representatives, volunteers and sponsors cannot assure participants’ safety during participation in the Event. I acknowledge and agree that participation in the Event exposes me/Minor(s) to risks including, but not limited to, physical injury and damage to or loss of personal property and I HEREBY EXPRESSLY ASSUME THE RISK of an injury or harm in participating in the Event. I am aware of and expressly assume all risks associated with participating in this Event, and asserts that my/Minor(s) participation in this Event is voluntary.
The Event may take place in public spaces and may offer services (including massage, medical or paramedical care, etc.) during the Event that are potentially hazardous activities that can result in serious personal injury or death.
Event may increase the risk of being exposed to or infected by COVID-19. COVID-19 may result in personal injury, illness, hospitalization, permanent disability, and death.
I on behalf of myself and the Minor(s) (if any) for whom I am a parent or legal guardian understand that any donations to the Foundation are non-refundable and non-transferable, even if I or the Minor(s) (if any) do not participate in the Event. I further understand that my registration fee is non-refundable, non-transferable, does not apply toward my fundraising commitment, and is not tax deductible.
- Content and Data
I/we grant(s) the Foundation a worldwide, perpetual, irrevocable, royalty-free and non-exclusive licence, as applicable, to use, distribute, reproduce, modify, adapt, publicly perform and publicly display and otherwise exploit such Content for the purposes of promoting the Event.
Each Event Participant consents to Foundation using and disclosing their personal information to Foundation’s agencies and other third parties engaged to provide services in connection with the Event for use for contacting the Event Participant in relation to the Event and the purposes set out in the privacy policy of Foundation at https://secure.supportsinai.ca/site/DocServer/PrivacyPolicy20211203.pdf.
By entering the Event, the Event Participant agrees that:
(a) They may be contacted by the Foundation (or an agent of the Foundation) to provide comments about the Event and the Foundation (or an agent of the Foundation) may take and use photos, videos, or recordings, their name, and/or likeness of them (the “Materials”) for Foundation’s future promotional and marketing purposes without further reference or compensation to them;
(b) The Foundation may duplicate, alter, adapt and utilise the Materials as Foundation wishes at any time, anywhere (including communicating them to the public in any media). Foundation may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
(c) They grant to Foundation on creation of the Materials a worldwide, perpetual, royalty-free, exclusive and irrevocable licence to use the Materials for whatever purpose it determines; and
(e) They unconditionally and irrevocably waive all moral rights in the Materials.
- General Provisions
This Release and Waiver shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Should any portion of this Release and Waiver be held to be invalid by any court of competent jurisdiction for any reason, such portion of this Release and Waiver shall be severable from the remaining provisions herein and shall not otherwise affect the remaining provisions of this Release and Waiver which shall continue to be enforceable.
I CERTIFY THAT I AM 18 YEARS OF AGE OR OLDER, THAT I AM PHYSICALLY CAPABLE TO PARTICIPATE IN THIS EVENT, THAT I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS AND I AM SIGNING BELOW OF MY OWN FREE WILL, WITH A WITNESS.
